Terms of Service
These Terms of Service (“Terms”) are a legal agreement between you and WirePitch (“we,” “us”) that govern your use of the WirePitch website, application, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
Operator. WirePitch is a service operated by Kristian Ponsford, based in Austin, Texas. Reach the operator at legal@wirepitch.com.
1. The Service
WirePitch is a two-sided marketplace. Guests (the people who want to be interviewed) create a profile and pay to receive AI-drafted pitches matched to relevant podcasts. Hosts (the people who run podcasts) join for free, claim the shows they run, and receive in-app pitches filtered by fit.
Pitches are drafted by AI and reviewed by the guest before delivery. We do not guarantee any specific outcome — including that a host will reply, that a pitch will lead to a booking, or that any particular volume of replies will be generated.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service you represent that you meet this requirement and that you have the authority to enter into these Terms (including, if you are using the Service on behalf of an organization, the authority to bind that organization).
3. Your account
- You are responsible for keeping your account credentials secure and for activity that occurs under your account.
- You agree to provide accurate, current information when you sign up, and to keep your profile information up to date. Knowingly false bios are grounds for suspension.
- One account per person. Hosts may claim multiple shows they actually operate; one show may not be claimed by someone other than its operator.
4. Acceptable use
You agree not to:
- Misrepresent your identity, your credentials, or your relationship to a company or show.
- Use the Service to send spam, harass anyone, or pitch content you do not have the right to discuss publicly.
- Attempt to reverse-engineer, scrape, or systematically extract the podcast catalog, embedding models, prompt templates, or other proprietary parts of the Service.
- Interfere with the Service, attempt to gain unauthorized access, probe for vulnerabilities outside of responsible disclosure, or transmit malicious code.
- Use automated means to create accounts, generate pitches, or send pitches at volumes inconsistent with normal human use.
- Use the Service in violation of any applicable law or third party right (including intellectual property, privacy, and publicity rights).
5. Content you provide
You retain ownership of the content you provide — your bio, your edits to drafted pitches, the shows you claim and the metadata you confirm. By providing content, you grant WirePitch a worldwide, non-exclusive, royalty-free license to host, store, display, process, and (in the case of guest profile content) send to our AI providers solely to operate and improve the Service.
You represent that the content you provide is yours to provide and does not violate the rights of any third party.
6. AI-drafted pitches
Pitches are drafted by AI models (currently Anthropic’s Claude) based on your profile and the target show’s public metadata. You are responsible for reviewing every pitch before you send it. Claims you make in a pitch — about your credentials, your work, your past appearances — are your claims, even when the AI drafted them. We do not represent that AI output is free of factual errors.
7. Hosts and show claims
- When you claim a show, you represent that you actually operate that show or have authority to act on behalf of its operator.
- We may verify a claim automatically (for example, by checking the email on the show’s public RSS feed) or by manual review. We may reject or revoke a claim at any time.
- Hosts grant guests no contractual obligation to reply, accept, or decline any pitch. Silence is a permitted response.
8. Pricing, payment, and refunds
Plans
- Campaign Launch — $499 one-time. One campaign of up to 25 pitches, with unlimited regenerations within that campaign. The campaign is considered complete when every pitch has been sent, or 90 days after purchase, whichever comes first. Creating an additional campaign requires an additional purchase.
- Coach Subscription — $99/month. One campaign per month plus premium features as they are released. A 7-day free trial is available; the trial does not require a payment method. Your campaign quota resets at the start of each billing cycle.
Payment
All payments are processed by Stripe. You authorize us (through Stripe) to charge the payment method you provide for the amounts due. Subscription fees recur automatically until cancelled.
Refunds
You may request a full refund within 7 days of your initial purchase. To be eligible, you must have completed at least one “send pitch” action through the Service. Refund requests can be made at /billing/refund from your account, or by email to billing@wirepitch.com. Refunds are approved manually and processed back to your original payment method.
Outside the 7-day window, payments are non-refundable except where required by law. Cancelling a subscription stops future charges but does not refund the current billing period.
Promotional codes
Promotional codes (including launch discount codes) are subject to their own terms — eligibility, redemption limits, expiry. A code may be revoked or modified before it is redeemed. Codes have no cash value and cannot be combined unless we explicitly allow it.
Taxes
Prices are exclusive of taxes unless otherwise stated. You are responsible for any taxes that apply to your purchase based on your location.
9. Cancellation and termination
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; access continues until then.
We may suspend or terminate your account if you violate these Terms, if your account is used in a way that creates risk for other users or for us, or if we are required to do so by law. If we terminate your account for a violation, you are not entitled to a refund of unused fees.
10. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure; that AI-drafted output will be accurate; or that the Service will produce any particular result.
11. Limitation of liability
To the maximum extent permitted by law, WirePitch (and our officers, employees, and providers) will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or lost business opportunity, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose or (b) one hundred U.S. dollars.
12. Indemnification
You agree to defend, indemnify, and hold harmless WirePitch from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service in violation of these Terms, or your violation of any third party right.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
14. Changes to these Terms
We may revise these Terms from time to time. We will post the revised version here with a new “Last updated” date. Material changes will be communicated to account holders by email before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
15. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and WirePitch regarding the Service.
- Severability. If any provision is held unenforceable, the remainder of the Terms remains in effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
